1. Who We Are

Kappture is operated by Agentic Intelligence Ltd, a company registered in New Zealand. In this policy, "Kappture", "we", "our", or "us" refers to Agentic Intelligence Ltd.

Kappture is an AI-powered meeting intelligence platform available via web application at kappture.app and through mobile applications on iOS and Android (collectively, the "Service").

By using the Service you agree to this Privacy Policy. If you do not agree, please do not access or use the Service.

2. Information We Collect

2.1 Account Information

When you create an account we collect:

• Name and email address
• Organisation name and job title
• Phone number (optional)
• Profile photo (optional)
• Authentication credentials (managed by Supabase Auth; we do not store passwords directly)

2.2 Recording & Meeting Data

When you use our recording and transcription features we process:

• Audio recordings you capture or upload
• Transcriptions generated from those recordings
• AI-generated summaries, action items, coaching feedback, and evaluations
• Speaker profiles and voice identification data
• Notes, bookmarks, and image captures you create during a session
• Evaluation framework scores and criteria

2.3 Payment Information

Payments are processed by Stripe. We do not store your credit card number or bank details. Stripe provides us with a customer identifier, plan details, and billing history. Stripe's own privacy policy governs payment data.

2.4 Automatically Collected Information

• Device type, operating system, and browser
• IP address and approximate geographic location
• Pages visited, features used, and session duration
• Error logs and performance metrics

3. How We Use Your Information

• Provide, operate, and improve the Service
• Process, store, and transcribe your audio recordings
• Generate AI-powered insights, evaluations, and coaching
• Manage your account, organisation, and team membership
• Process payments and manage subscriptions
• Send transactional emails and service notifications
• Detect fraud, abuse, and security incidents
• Comply with legal obligations

We do not use your recordings, transcriptions, or personal data to train AI models.

4. AI Processing & Third-Party Models

Kappture uses third-party AI services to provide transcription and analysis:

• OpenAI — audio transcription (Whisper) and text analysis
• Anthropic — summarisation, evaluation, and coaching

Data sent to these providers is governed by our data processing agreements with them. Neither OpenAI nor Anthropic uses API inputs to train their models. All AI-generated outputs are stored within your account and subject to the same security measures as your other data.

5. Data Storage & Security

Your data is hosted on infrastructure provided by Supabase (database and authentication), Fly.io (application server), and cloud storage for audio files. We implement:

• Encryption at rest (AES-256) for all stored data
• TLS 1.3 encryption for all data in transit
• Row-level security policies ensuring strict tenant isolation
• Role-based access controls and audit logging
• JWT-based authentication with automatic token refresh

While we take reasonable measures to protect your data, no system is completely secure. You are responsible for keeping your account credentials confidential.

6. Data Sharing & Disclosure

We do not sell your personal information. We may share data with:

• Service providers — third parties that help us operate the platform (e.g., OpenAI, Anthropic, Stripe, Supabase, Fly.io), under contractual obligations to protect your data.
• Your organisation — other members of your team or organisation as configured by your administrator.
• Legal requirements — when required by law, regulation, court order, or governmental request.
• Business transfers — in connection with a merger, acquisition, or sale of all or part of our assets, with prior notice where practicable.

7. Data Retention

We retain your data for as long as your account is active or as needed to provide the Service. You may delete individual recordings and associated data at any time. Upon account deletion, we will remove your personal data within 30 days, except where retention is required by law.

8. Your Rights

Under the New Zealand Privacy Act 2020 and, where applicable, the EU/UK GDPR and the Australian Privacy Act 1988, you have the right to:

• Access the personal information we hold about you
• Request correction of inaccurate or incomplete information
• Request deletion of your personal information
• Export your data in a portable format
• Object to or restrict certain processing activities
• Withdraw consent where processing is based on consent
• Lodge a complaint with the NZ Privacy Commissioner or relevant supervisory authority

9. International Data Transfers

Your data may be transferred to and processed in countries other than New Zealand, including the United States (where our AI and infrastructure providers operate). We ensure appropriate safeguards are in place, including Standard Contractual Clauses (SCCs) where required by applicable law.

10. Cookies & Local Storage

We use essential cookies and local storage to maintain your authentication session and preferences (such as dark mode). We do not use third-party advertising or tracking cookies. We may use minimal analytics to understand usage patterns; you can opt out through your browser settings.

11. Children's Privacy

The Service is not intended for individuals under 16 years of age. We do not knowingly collect personal information from children. If we become aware that we have collected data from a child under 16, we will delete it promptly.

12. Recording Consent

You are solely responsible for complying with all applicable laws regarding recording consent. Many jurisdictions, including New Zealand, require the knowledge or consent of parties being recorded. Kappture provides tools to facilitate consent but legal responsibility lies with you.

13. Changes to This Policy

We may update this Privacy Policy from time to time. Material changes will be communicated via email or in-app notification at least 14 days before taking effect. The "Last updated" date at the top of this page indicates when the policy was last revised.
